Question 1- Motions are considered by most as a necessary element in the criminal justice process.
Why? do you support this positions? what is the suppressing ruled called?
Answer: The suppressing rule is a 1538 motion. I do support this because it is a necessary element in the criminal justice process and being a criminal justice professional, I will have to follow the rules established by our system of justice. Although I nay not enjoy being on the receiving end of this motion,I realize it opens the gates for other processes in court.
Question 2 - What is this person trying to prove with this upload?
Answer: I believe this person is trying to test the officers to see if they violated his 4th amendment rights. Those questions were specifically crafted to push the officers to an attitude arrest, and those questions were justified. The officers did the appropriate action by releasing the person who challenged their authority. By 1, officer observations which verified he was a U.S. citizen (a) speaking clear and understandable English, (2) taking to account all other elements of observation it was the only decision for law enforcement at that time.
Question: Who pursues charges against a defendant?
Answer: Police officers do not have to pursue charges against a defendant. The DA may decide to pursue charges against the defendant. Pursuing charges and over charging are considered to have leverage in negotiations in many cases. Except in murder cases, there is always discussions to pursue charges but they can be of a lessor charge.
